19 I'm sure by now you have come to appreciate how very

20 important and difficult it is to serve as a juror.

21 These are very difficult questions of fact that must be

22 resolved, and under our system of law these questions

23 can only be resolved by ordinary citizens. So I want

24 to again thank you for your willingness to participate.

25 I know you paid careful attention to the evidence in

1 this matter, and I know that you performed your service

2 as jurors to the best of your ability.

3 Our system of criminal justice requires and

4 anticipates that jury deliberations will remain

5 confidential, and that is how that prospective jurors

6 can always expect that their deliberations would also

7 remain confidential. No one is permitted to question

8 you about why you reached this result or about your

9 deliberations. You're entitled to keep them

10 confidential and you don't have to speak to anyone

11 about your deliberations.

12 Please understand that if you ever did speak

13 to anyone about your deliberations and that they

14 reported that matter to the Court and it raised

15 questions then it would be possible that you would have

16 to come back and explain whatever it is that you said

17 under oath in some type of a proceeding to find out

18 what exactly was said. So, please keep in mind your

19 deliberations are confidential. In any event, again, I

20 want to thank you very much. You are now excused and I

21 hope that you have learned a great deal about our

22 system of law. Thank you.

24 THE COURT: All right. Counsel, any matters

25 that you want to address before I order a presentence

2 MR. MARAIN: No, your Honor.

3 THE COURT: Mr. Storch?

4 MR. STORCH: No, your Honor.

5 THE COURT: All right. I am going to order a

6 presentence report in this case. It is my recollection

7 this is the only outstanding charge pending against Ms.

8 Riles, is that correct?

9 MR. MARAIN: That is all that I am aware of.

10 THE COURT: Mr. Storch?

11 MR. STORCH: That is all I know.

12 THE COURT: Okay. So I will order a

13 presentence report and, let's see --

14 MR. MARAIN: Judge, I will be away the weeks

15 of April 26th and May 3rd.

16 THE COURT: Okay.

17 MR. MARAIN: I will also be away on the day

18 -- on the days of May 14 and May 17.

19 THE COURT: Would that make you here on May

20 10th?

21 MR. MARAIN: I will be here May 10th.

22 THE COURT: All right. Then let's schedule

23 sentencing for May 10th. Now, also, Mr. Marain, I

24 guess you can confirm, Ms. Riles, as I recall, is not

25 on probation or parole at this time?

1 MR. MARAIN: That is correct.

2 THE DEFENDANT: No, I'm not on parole.

3 THE COURT: So this would be a great

4 sentencing on the charge of remaining in a public place

5 for failure to -- I mean with purpose to obtaining or

6 sell C. D. S., and sentencing will take place on May

7 10th and we need a notice for Ms. Riles. Okay.

8 Counsel, thank you very much.

9 MR. MARAIN: Thank you.

10 THE COURT: Sorry we had to come back here
